Unlike many state laws, the UCMJ does not have a provision that provides exceptions for parties who have reached almost the same age. For example, if an 18-year-old soldier has sex with a 15-and-a-half-year-old girl, he commits a crime, even if she agrees. However, the day she turns 16, it is legal for them to have sex. Once a person reaches the legal minimum age of his state, he can conclude legally enforceable agreements. Minors do not have the legal capacity to enter into a binding contract. However, an agreement entered into when a person was a minor may be ratified, expressly or implicitly, once he or she has reached the legal age of majority, so that the agreement becomes valid and binding. The legal age of majority is separate from the legal age of licensing. The legal driving age is the minimum age a person must reach to legally participate in certain activities such as drinking alcohol, voting or driving. The legal age of the license varies depending on the activity and jurisdiction and may, but does not necessarily have to correspond, to the legal age of majority. The UCMJ article, which prohibits sexual relations with people under the age to consent to the military, is very short. The law does not list a specific penalty for the crime, but only says “how it can order a court martial.” This likely means for consensual sex that any punishment can be imposed shortly before death, including dishonorable release and imprisonment.

If sex is consensual, the crime is called “carnal knowledge” and cannot be punished with death. However, if the sex is not consensual, it is considered “rape” and can be punished with death. The UCMJ allows an error of fact to act as a defence in these cases. If the victim is indeed over 12 years of age and the perpetrator reasonably assumed that he was 16 years of age or older, then this fact is a valid defence and the member will not be punished. For members of the U.S. military, behavior is governed by the military`s own law, the Uniform Code of Military Justice (UCMJ).
For military personnel, the crime of rape can (and has been) punishable by death. Being accused of the crime of having sex with a minor is a very serious matter. The punishment for this crime is much harsher in military courts than in U.S. criminal courts. An experienced military lawyer can represent you and help you reduce your sentence or even dismiss your charges, so it may be advisable to hire a civilian criminal defense lawyer. The age of consent for military personnel is 16 years. This means that a member who has sex with a person under the age of 16 commits a crime.
